By entering this Promotion, you are taken to have accepted these terms and conditions.
Entry is only open to residents of Australia aged 18 years and above. Employees, directors, officers and other staff (including contractors) of the Promoter, or of the agencies or companies associated with the promotion, and their immediate families are ineligible to enter.
Promotion commences at 9:00am on 7 October 2016, and closes at 11:30pm on 28 October 2016.
For a person to enter, they must “Like” the Scope (Aust) Ltd Facebook page and must leave a comment against one of the weekly Facebook posts about the promotion. The comment must state in 25 words or less how the Tools2Talk+ app could help someone to overcome a communication barrier. A person may only enter in their own name.
Entries must be received during the Promotion Period. Only one entry per person is permitted.
The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks or services, the Internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Any form of automated entry using any device or software is invalid.
All entries and materials submitted to the Promoter in connection with this Promotion become the property of the Promoter and each entrant warrants that they have the right to transfer these to the Promoter. Each entry must be the entrant’s original work. By entering this Promotion, the entrant:
consents to the Promoter making copies of or publishing the whole or any part of their entry and otherwise exploiting the entry and any rights in relation to the entry, to publicise this Promotion or for any other purposes; and
undertakes to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights.
The Promoter accepts no responsibility for any breach of contract or any infringement or other violation of copyright or any other intellectual property rights or proprietary rights through the acceptance of entries into this Promotion and each entrant takes full responsibility for any such claims made in relation to their entry.
This is a game of skill and chance plays no part in determining the winner. Each valid entry will be individually judged based on originality and creative merit.
The judges’ decisions are final and no correspondence will be entered into.
Entries will be judged by Scope representatives, on Monday 31 October 2016. The prize will be awarded to the valid entrant who best meets the judging criteria, as determined by the judges in their sole discretion.
Incomplete entries and/or entries that, in the Promoter’s judgment, contain offensive, defamatory or otherwise objectionable or inappropriate material or that infringe any third party rights will be invalid.
The winning entry will win a free copy of the Tools2Talk+ app, provided to the winner in the form of a free Tools2Talk+ app code that allows the Tools2Talk+ app to be downloaded from iTunes app store within 30 days of receipt of the code. The Tools2Talk+ app is only for iPad use and cannot be used on android platforms or other Apple devices. The total value of the prize is A$74.99. Once awarded, the Promoter shall not be responsible for any app code that has been lost, stolen, forged or tampered with in any way.
The winner will be notified via Facebook message on Monday 31 October 2016. The results will be published on the Scope (Aust) Ltd Facebook page once the winner has been notified.
The winner must claim their prize by Friday 4 November 2016, by responding to the Facebook message and providing a valid email address for the prize to be sent to.
Before receiving the prize the winner may be required to confirm their identity by producing such photo or other identification as may be directed by the Promoter.
If the prize has not been claimed by the winner by 5:00pm Friday 4 November 2016 it will be awarded to the next best valid entry as determined by the judges. The alternative winner must claim the prize as per the requirements in paragraph 16 within two days of notification, or another alternative winner will be selected in accordance with the process set out in this paragraph 18.
The prize is not redeemable for cash and cannot be transferred or exchanged.
Nothing in these terms and conditions is intended to exclude, restrict or modify rights which you may have under any law (including the Australian Consumer Law (ACL), and consumer guarantees relating to goods or services under the ACL) which may not be excluded, restricted or modified by agreement (Your Consumer Rights). Subject to Your Consumer Rights, the Promoter is not liable for any loss or damage however caused (including by negligence), suffered or incurred in connection with the Promotion or the prize. Any condition or warranty which would be implied by law into these terms and conditions is excluded.
The Promotion is in no way sponsored, endorsed, administered or associated with Facebook. By entering and participating, entrant agrees to hold harmless, defend and indemnify Facebook from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of or related to (i) entrant’s participation in the competition, or (ii) entrant’s participation in any Prize related activities, acceptance of a Prize and/or use or misuse of a Prize (including, without limitation, any property loss, damage, personal injury or death caused to any person(s).
The Promoter may, in its sole discretion, disqualify any or all entries from, and prohibit further participation in this Promotion by, any person who fails to provide adequate identification to the satisfaction of the Promoter, or who tampers with or benefits from any tampering with the entry process or with the operation of the Promotion or acts in violation of these Terms of Entry, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
If due to any reason whatsoever the Promoter becomes aware after an entrant has won a prize that the entrant has not complied with these terms, that entrant will have no entitlement to the prize, even if the Promoter has announced them as a winner and that entrant will be required, at the direction of the Promoter, to return, refund or otherwise make restitution of the prize.
Prize Value is as specified on the date on which these Terms of Entry are published on the Scope website. The Promoter accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant authorities in the Relevant State/s, if required.
If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to the approval of the relevant authorities in each Relevant State/Territory, if required.
